Another reason to have a GoPro shooting video. And a phone handy to call the DFG...or would you call the cops in that situation?

Re: How I respond to misinformed busy-body vigilantes harassing me about MLPAs

With all due respect, I think that even when they're flat out wrong, someone challenging you for diving in a reserve or breaking a game law doesn't even begin to approach the legal threshold of harassment. So quoting a DFG regulation intended to stop PETA and their ilk from throwing blood on hunters, destroying property and physically threatening people is a really empty threat.

Why not just pull out your map and say, "I can understand why you're confused but if you look at this map you'll see that the reserve starts right THERE and we are right HERE."

Or if you don't want to do that, then ignore them at will.

Call it how you see it, but if someone wants to challenge or detain me, even momentary, with out having first learned the facts Im calling it harassment.

This is about responding to efforts to intimidate divers and Im taking a hard line with these kooks. I'd like to see them in court defending their actions or at least having to explain to the warden they were using false information to keep a sportsmen from a legal activity.

Why not pull out the map and explain first? Because if they want to impede or lecture me they should know the map! If they dont they are harassing me and Im calling the DFG and UCSB police (who i have already had friendly contact with on this very topic) and asking that they be charged.

Pushing back is the right course of action in dealing with this situation; the time for gentle education of those who would eliminate our diving outside the already onerous laws is over as far as Im concerned. Look at the post that prompted this thread, these people are full of s%@#*t and willing to lie in order to bluff us off our reefs. Im finished accommodating my enemies

How can this not get people worked up? We hear it ALL THE TIME at the Children's Pool. When the new reserves went into effect, the enviros were bragging over a megaphone how we couldn't dive there anymore. They were flat-ass wrong and we had to educate the ranger that the MPAs did not in-fact cover central La Jolla. It is all BS. We have called DFG numerous times about the harassment and they have never sent anyone down to even investigate. They ignore us and claim "lack of manpower". They have actually told us that enforcing harassment violations is not a priority for them.

^Bring it up at the Fish and Game Commission. You're right, it isn't a priority. It never will be if left unchallenged.

Re: How I respond to misinformed busy-body vigilantes harassing me about MLPAs

I understand why it bothers you to deal with ignorant people, but the code is actually very specific. It says, "Interfere with the participation of" not "harass" and it explains what interfere with means. Unless someone is physically restraining or impeding you, they're not "interfering".

From 2009:

(f) For purposes of this section, "interfere with" means any
action which physically impedes, hinders, or obstructs the lawful
pursuit of any of the above-mentioned activities, including, but not
limited to, all of the following:
(1) Actions taken for the purpose of frightening away animals from
the location where the lawful activity is taking place.
(2) Placing or maintaining signs, gates, locks, or barricades that
prohibit or deny access to lands without authorization from the
landowner or lessee or an authorized designee of the landowner or
lessee.
(3) Placing food on lands not belonging to the person placing the
food for purposes of eliminating the lawful ability to hunt due to
the presence of bait, as defined in this code or regulations adopted
pursuant to this code.

Okay; in regards to the Childrens' Pool. Read rule #2. Think about the illegal rope they put up.

And then drink a giant glass of Shut the Phuck up.

Damn... Couldn't have said it better. Or how about "physically hinders or obstructs". The wardens wouldn't do shit even with video evidence, and about six calls to cal-tip. We could never get them to do anything. However, more calls in other locations may encourage them to begin enforcement.

X probably about 200.....or more.

I have F&G Code 2009 laminated along with all the Closures in my neck of the woods in my vessel at all times.

Jeremy is right on with this action. It's time we all start sticking up for ourselfs ,and our rights.

Anyone tells me I cant do this or that when I'm legal ,Im gonna consider it harrassment ,and start the Go Pro,and push it just as far as I can.
I'm sick of these people jamming thier crap down our throats all the time ,and then when we exercise our RIGHTS to LEGALLY FISH we are the bad guys? Well no more. Know the laws. Exercise your rights to fish. And when people push ,push back!

MJ.
