With all due respect, I think that even when they're flat out wrong, someone challenging you for diving in a reserve or breaking a game law doesn't even begin to approach the legal threshold of harassment. So quoting a DFG regulation intended to stop PETA and their ilk from throwing blood on hunters, destroying property and physically threatening people is a really empty threat.
Why not just pull out your map and say, "I can understand why you're confused but if you look at this map you'll see that the reserve starts right THERE and we are right HERE." Or if you don't want to do that, then ignore them at will. |

Pushing back is the right course of action in dealing with this situation; the time for gentle education of those who would eliminate our diving outside the already onerous laws is over as far as Im concerned. How can this not get people worked up? We hear it ALL THE TIME at the Children's Pool. When the new reserves went into effect, the enviros were bragging over a megaphone how we couldn't dive there anymore. They were flat-ass wrong and we had to educate the ranger that the MPAs did not in-fact cover central La Jolla. It is all BS. We have called DFG numerous times about the harassment and they have never sent anyone down to even investigate. They ignore us and claim "lack of manpower". They have actually told us that enforcing harassment violations is not a priority for them.

^Bring it up at the Fish and Game Commission. You're right, it isn't a priority. It never will be if left unchallenged.

I understand why it bothers you to deal with ignorant people, but the code is actually very specific. It says, "Interfere with the participation of" not "harass" and it explains what interfere with means. Unless someone is physically restraining or impeding you, they're not "interfering".
From 2009: (f) For purposes of this section, "interfere with" means any action which physically impedes, hinders, or obstructs the lawful pursuit of any of the above-mentioned activities, including, but not limited to, all of the following: (1) Actions taken for the purpose of frightening away animals from the location where the lawful activity is taking place. (2) Placing or maintaining signs, gates, locks, or barricades that prohibit or deny access to lands without authorization from the landowner or lessee or an authorized designee of the landowner or lessee. (3) Placing food on lands not belonging to the person placing the food for purposes of eliminating the lawful ability to hunt due to the presence of bait, as defined in this code or regulations adopted pursuant to this code. |

Damn... Couldn't have said it better. Or how about "physically hinders or obstructs". The wardens wouldn't do shit even with video evidence, and about six calls to cal-tip. We could never get them to do anything. However, more calls in other locations may encourage them to begin enforcement.
