biscayne bay regultaions so confusing.

Im trying to know if I can take my yak on biscayne bay, close to key biscayne,
soldier key, Boca Chita key, and elliot key, and spearfish on the bay side or the ocean side .
IT IS SO CONFUNSING .

Spearfishing is permiteed in Biscayne national Park in accordance with all Florida state regulations.---

They say, IT IS permitted .

but then I remeber see posts in spearboard that IS NOT permitted, and some of them says : Ye sis permited on bay side, other say is permited only on ocean side 3 miles away .

there is a map, than INCLUDES all biscayne National Park, as a Sanctuary .


ANY ONE HAS GOOD INFORMATION ?

Ezequiel to my knowledge it is permitted (pertaining to the area in question- soldier key, Boca Chita key, and elliot key) but lobstering is not. Head out of BP better spearing(bay) there than outa BF(bay).

Spearfishing in the park is permitted. There was a push a while back to limit it to sling only and no tanks but it got dropped. Thank the FRA and FWC for that. Lobstering is what is restricted inside the designated sanctuary area....not spearfishing.

I was actually wondering the same thing. I was looking at the wrecks inside biscayne bay national and then I noticed that it was all inside a sanctuary. When I looked up the rules I noticed that it said that it is allowed (to spear). So I was super confused. Now I know for sure that we can spear it.

Not if you are going in at Cape Florida.....you can not bring a speargun into any Florida state park. You could in a few select places in Key Biscayne but your options are very limited and you are likely to encounter great resistance from the locals and LE. Best to access it from a boat

There are only two and I hear one of them lost all access after the homeowners closed off the street and made it a private drive. The only one I can think of now that would work is Bear Cut bridge....catch it at slack tide though because the current RIPS through there. Carry a float with a large flag....boat traffic is bad through there. There are other better places for a "guerilla" shore dive in Dade.....do you not have access to a small boat...even a yak?

First, is it a bad idea to tie off to the bear cut bridge and sit in the current waiting for fish?
Second, where are the other, "better" guerilla fiving spots in the area?

you are allowed to spear everywhere within the bay that is otherwise legal, meaning, if there is no public beach or fishing pier within the designated distance you can spear.

you cannot take bugs.

No I don't . I been wanting to buy a yak but $$$ is short right now. No boat acess at all, don't know anyone that owns one. Thanks alot for your info, I'll give that bridge a look.

there is the half moon wreck in bear cut, but it is outside of the bay. it has some fish but nothing huge and decent bugs in the early season.
bear cut bridge holds lot of fish...and sharks, but you can't see them so they clearly can't see you

I find that there are a ton of fish in and around the bay, the lack of structure to aggregate them is why some people say there is no good spearing in the bay
