ny speargun bass reg update

so got some info today from state dec officer that bill passed YESTERDAY that is officially banning use if spearguns for bass....BUT hawiian slings and pole spears will be legal.. from what i was told someone was already issued tickets for shooting bass in moriches, but they were being assholes and shooting 25" bass so they completely deserve it. as of this year warnings are still going to be issued unless you have over bag limit, under sized fish, all that breaking the regulations stuff is just gonna get you one more ticket if cought.. just figured id share the exciting bullshit new regulations, thanks new york

I do believe that they had some bad information. From this --> http://open.nysenate.gov/legislation/bill/S5684-2011 its my understanding that its now LEGAL to take bass both commercially and recreationally by speargun.

Hmmm ill have to show this to him tonight, and see what he says because he showed me memo from albany stating that speargun for striped bass must be enforced heavily... this annoyance of a regulation still seems to be mixed up between us and law enforcemt.. thanks for link that is good proof

Reading the above makes me think rec or comm taking of bass with a speargun is now legal. What wasnt mentioned was can the spear be mechanically propelled or not? Section40.1(j)(22) states that NYSDEC currently allows the use of spearguns for recreational taking of bass? That is the confusing part of what I read.Being that a speargun is mechanically propelled currently its not allowed. I just left a meassage with Fred Thiele's secretary and if I hear back I will post what he said.
With regard to what Rob posted,it wouldnt be the first time an officer didnt know the law he/she was enforcing.Especially with a bill that just passed two weeks ago.

Yeah, I agree, This was amended to add commercial use. If you are not sure, print it out, laminate it and keep it with you.

Nothing worse than having your balls busted by ill informed enforcement officers.

I spoke to the president of LIDA Bill Pfeiffer who has been in direct contact with the Directors of freshwater and Marine Fisheries for the NYDEC. LIDA shares a very close relationship with the DEC and assists often with their research and legislation decisions. Here is the information as he got it directly from them.

"Hi Matt, I talked to the Saltwater Fisheries representative at DEC. Here are the facts.
NO NEW LAWS HAVE BEEN PASSED!
It would appear that a recent review of current law shows that spearguns may have always been banned for any species of fish, fresh or saltwater, anywhere in the State of New York. That was not the intent of the law, it was just poorly written long, long ago. The law is currently being reviewed by DEC attorneys to determine whether the law should be revised, or completely re-written. The use of spearguns in New York enjoys a healthy precedent, and that is of prime consideration in this circumstance. If the law were to be re-written to change this precedent then public announcements and comment periods would apply. So, go shoot some bass!"


I would also add that if anyone is getting ticketed for spearfishing by DEC officers or hearing from DEC officers that spearfishing in marine waters is banned that they let me know the exact circumstances of the situation and the name of the officer.

Wow! This guy Chris is way off base and I found his comment extremely
insulting. If he thinks this is some sort of game and doesn't think we are passionate, he is in for a rude awakening !
By the way, did anyone else notice how upset the Northeast members (Yes I'm a member) are about Noreast's new censorship policy?
We need to band together brothers and sisters, the time is NOW!

I'm almost positive Chris is on our side, I think his comment about spearing trash fish was sarcastic (hence the rolled back eyes). He did us a service by listing the local representatives and researching the laws. At this point we need to write in to representatives and gather support. If this law passes we're good but if it doesn't Spearfishing in ny as we know it will be over.

Noreast is a strong community and is supportive of what we do, hopefully they can help our cause.

You're probably right Tom, I'm gonna start writing letters to the people who make the decisions and think positive.

Keep up the good work with the letters and emails! I have a source that informed me our voice is being heard loud and clear in Albany. I was pleased to hear this and I’m optimistic, hopefully the law makers and DEC will do the right thing. I believe that a lot of recreational fishermen are showing support and standing up for our rights and fishing rights in general, I thank everybody on spearboard as well as noreast for helping spread the word. Keep it up!

I purchased a spear gun direct from omar in virginia a few years back they charged a 15 % federal tax on spear guns i called and asked why? They said because the govt can thats why. Well you cannot tax me then tell me i can not use the spear gun..now from what i understand native americans do not have to follow the same rules..why?? Does our govt fell bad that we took the land from them shot and killed them ,took the buffalo.put them on resavation..now give them gambeling casinos they pay no taxes and do not have to follow the fishing regs or even register for the salt water fishing permit its in the fine print on the salt apps.some thing is wrong here..can not put my finger on it...but since i was born in the usa i am official native american ...am i looking at this wrong? I also want a free casino do not want to pay tax on gas or my alcohol or my cigars..why not i was born here in the usa..i am native american my birth cert states born in the usa new york...i thought we are all equal under the constution now that changes when it comes to fishing????
