Decided it's better to sit on the sidelines I'm not a lawyer and don't care about wether or not powerheads are legal or not! The cops aren't going to save me from an asshole shark!

I actually emailed SpearitPBC before I pulled the trigger on a shark shield, she convinced me it was a good investment and she could have not been more on the money. Again after buying it and watching it actually work I am sold.

Oh I also just got off the phone with the ATF here in Ft Myers they told me not to bother them with petty bullshit like power heads for spearfishing. Maybe I'll tack weld mine to a spear and Screamineagle will get the sand out of his Vag for me.

In the 27 years I've been involved in both NFA weapons and the business end of guns, I've had ONE (count it, ONE) inspection by ATF, and one phone call for some information regarding some paperwork. Actually very nice and professional both times - maybe I got lucky. Suffice to say, I think Baccala is correct with regards to the ATF not really giving a shit about spear powerheads used the way we use them. Pardon the pun, but they've got bigger fish to fry. I doubt anyone has ever encountered an ATF agent at the docks.

Borrowed a friend's Shark Shield for test dive. Found a 65' hot ledge with great plumes of bait and plenty of grouper. Had 50 min of bottom time and basically limited the boat. Had one shark come in and he left immediately despite the presence of a full stringer and lots of kill scent. I am sold on this unit, so nice to surface without company

Wow. You guys are missing the entire point here. I was never advocating for the Feds nor was I insinuating that the ATF is going to kick you door down and search your dive bag. But on the off chance that something bad happens or somebody gets hurt on a dive boat and it is because of an illegal powerhead people should know they could end up in a federal prison over it. As for never seeing the ATF, we get a visit from them at least every other year now. In regards to what the douche was saying about the ATF in FT. Myers not being worried about such insignificant matters, I call "bull shit". There is no such thing as a "G Man" that is going to tell you it is O.K. to violate any law no matter how insignificant. The moral of this story and what propagated me to post in the first place is this. A few years ago me and some friends were coming back from Key West on the express ferry to Ft. Myers. Upon arrival an agent with the Department of Homeland Security (and come to find out later he was former ATF) and an FWC officer pulled us to the side and searched everything we had. I had (2) .357 slip on's and (2) 44 mag. slip on's. I was informed they were in violation of the ferry companies policy and nothing more was said about it as we were finished with our trip. My buddy however had a .223 powerhead in the pocket of his B.C. (the spot welds had been ground off) The agent was less than amused but very politely ask my friend if this highly illegal device was accidentally broken while on the dive trip or if he had modified it to fit in his pocket (hint hint)? He promptly confiscated the device and escorted us from the building. Knowledge is power.

I don't know what got your panties in such a twist and I really don't care what you do with your powerheads. I was only trying to help educate people whereas you just spew misinformation. If you would like to continue to discuss this further I will be in Ft. Meyers sometime late tomorrow and will be in town for a couple weeks thereafter for what I hope is some good shooting. I'm tired of bickering back and forth on this thread. Let me know I'll be at Dock Fords when I'm not on the water.

Eagle - I am still a little confused on the legalities here - ATF regs/laws seem to be kid of vague. Honestly not trying to start a fight - I just want some education for me and everyone else.

From what I'm reading, as long as your delivery device (hand held or spear mounted) is more than 26" long, you can have a slip on or screw on with firing pin/cotter pin safety and it won't be an AOW? But anything shorter will be considered an AOW and have to be stamped?

BTW - is your name a reference to the 101st? Met a few during my AF days at Lackland - always felt they never got the same props as the 82nd.

As far as I know anything that has a mechanical firing mechanism would have to be permanently 26" or longer to be completely legal. It is pretty much common knowledge to the manufacturing industry and the end users of power heads that they are built in a manner that makes them very easy to remove the factory installed rod that is barely tack welded to them. This is so you can stick several of them in your pocket. Everybody does it and everybody knows it. My only point was that if you run into the right asshole and he pushes the issue, you could get in a lot of trouble. The way the power head originally comes from the manufacture is the only sure fire legal way to possess them. The power head would still be in violation of the law even if it were screwed to a 60" shaft as long as it was threaded and removable. A good comparison is the Colt AR-15 that came out post Brady ban with a 10-1/2" barrel. It had a 6" pinned and welded flash suppressor which made it legal. As for your last question I was in the 82nd. 118 MP CO (ABN). I ride a "Screamin Eagle".

Gotcha - an awful lot of "grey area" with regards to this. Hopefully none of us spearos ever run afoul of "the man".
